The Leslie's Summer Salute Sweepstakes, as outlined below, (the "Promotion") is promoted and sponsored by Leslie's Poolmart, Inc., 2005 E. Indian School Rd., Phoenix, AZ 85016 ("Leslie's" or "Sponsor") and is governed by these Official Rules. Leslie's will administer the Promotion.

As a condition of participating in the Promotion, you agree to be fully and unconditionally bound by these Official Rules and the decisions of Sponsor, whose decisions shall be final and binding in all respects, and to waive any right to claim ambiguity in the Promotion, these Official Rules, Promotion materials, information contained on Sponsor's website, available at https://www.lesliespool.com, or Sponsor's Facebook page, available at https://www.facebook.com/lesliespoolcare or Instagram page, available at https://www.instagram.com/lesliespoolcare/. The Promotion is subject to applicable federal, state and local laws and regulations and is VOID WHERE PROHIBITED OR RESTRICTED BY LAW. Winning and receiving a Prize (as defined in Section 6) is contingent upon fulfilling all requirements set forth herein.

1. FACEBOOK® AND INSTAGRAM® DISCLAIMER

As a condition of participating in the Promotion, you agree and acknowledge that Facebook Inc. and Instagram LLC, and their owners directors, officers, employees, contractors, agents, representatives, parents, subsidiaries, attorneys, insurers, and associated corporations and entities (collectively, the "Facebook/Instagram Group") are not sponsors of the Promotion nor do they endorse or administer the Promotion, nor are they in any way associated with the Promotion. All questions regarding the Promotion must be directed to Sponsor, not the Facebook/Instagram Group. You also agree that as a condition of participating in the Promotion, you shall release the Facebook/Instagram Group from any and all liability arising out of or relating to your entry, creation of an entry or submission of an entry, participation in the Promotion, acceptance, use, or misuse of any Prize, or the broadcast, exploitation, or use of an entry.

2. PROMOTION PERIOD

The entry period for the Promotion begins September 30, 2020 at 12:00 a.m. Pacific Standard Time ("PST") and will end on October 21, 2020 at 11:59 p.m. PST (the "Promotion Period"). Pacific Standard Time shall control for all purposes of the Promotion. Sponsor's computer shall be the official clock for purposes of the Promotion.

3. ELIGIBILITY

The Promotion is limited to: (i) legal residents of the United States or the District of Columbia (excluding Alaska, Florida, Hawaii, New York and Rhode Island) that are physically located and residing or based therein;

(ii) are at least eighteen (18) years of age or older at the time of entry; and

(iii) are not a person barred from participation in the Promotion. Legal residents of Alaska, Florida, Hawaii, New York and Rhode Island are not eligible to participate in the Promotion. If a Potential Winner is at least eighteen (18) years of age but still considered a minor in his/her jurisdiction of residence, the Prize may be awarded in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on winners set forth herein. Directors, officers, employees, contractors, agents or representatives of Leslie's (d/b/a "Leslie's Swimming Pool Supplies"), and each of their respective parents, subsidiaries, distributors, retailers, suppliers, advertising and promotion agencies, and any and all other companies associated with the design or execution of the Promotion, as well as their immediate family and household members, whether related or not, are not eligible to enter the Promotion. "Immediate family" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings or spouses. "Household members" shall mean those persons who share the same residence at least three (3) months a year.

4. HOW TO ENTER

During the Promotion Period, you may enter by the following methods:

(a) Instagram Method of Entry

You may submit multiple entries into the Promotion each day during the Promotion Period by following these steps:

i. Follow Leslie's on Instagram (@lesliespoolcare);

ii. Take a photograph ("Photo") that complies with (i) these Official Rules and (ii) the Instagram Terms of Use, available at http://instagram.com/about/legal/terms/;

iii. Post the Photo publicly to your individual Instagram account;

iv. Tag @lesliespoolcare; and

v. Include @lesliespoolcare and #sweepstakes #LesliesSummerSalute in the caption.

Registration with Instagram is required to enter a Photo into the Promotion. If you do not have an Instagram account, visit www.Instagram.com or download the free Instagram app on your iOS or Android device from the App Store or Google Play, as applicable based upon your device, and create a free account as instructed. Instagram Photo entries must be posted to your public Instagram account to be entered into the Promotion.

(b) Facebook Method of Entry

You may submit multiple entries into the Promotion each day during the Promotion Period by following these steps:

i. Like the official Leslie's Summer Salute Sweepstakes post on the Leslie's Facebook Page (@lesliespoolcare);

ii. Comment on the official Leslie's Summer Salute Sweepstakes post with a Photo of your best "Salute to Summer" memory: 1. Your Photo must comply with (i) these Official Rules and (ii) the Facebook Terms of Service, available at https://www.facebook.com/legal/terms.

Registration with Facebook is required to enter into the Promotion. If you do not have a Facebook account, visit www.facebook.com or download the free Facebook app on your iOS or Android device from the App Store or Google Play, as applicable based upon your device, and create a free account as instructed. Facebook entries must be posted as a comment on the official Leslie's Summer Salute Sweepstakes post to be entered into the Promotion.

(c) Alternative Method of Entry

Alternatively, you may enter by mailing a letter or postcard with your full name, street address and valid email address to Summer Salute Sweepstakes, 2005 E. Indian School Road, Phoenix, AZ 85016, Attention: K. Loubet, Marketing Department. Each letter or postcard will constitute one entry subject to these Official Rules. You may submit multiple entries into the Promotion via this method provided that the alternative entries must be postmarked and received during the Promotion Period to be included in the random drawing for the Promotion. Any alternative entries with an invalid email address will be disqualified from the Promotion. Multiple entries per person or household will be accepted and entered, but only one (1) Prize will be awarded per person or household. Failure to comply with this or any other official rule will result in disqualification. Leslie's is not responsible for inaccurate entry information or for lost, misdirected, late, incomplete, illegible or unintelligible entries, whether caused by entrant or by any of the equipment or programming associated with or utilized in this Promotion, or by any technical or human error that may occur in the processing of entries. Mechanically reproduced entries are not permitted and will be deemed void. Illegible/incomplete entries are void. All entries become the property of Leslie's and will not be acknowledged or returned. Only bona fide, legitimate good faith entries are eligible.

5. PHOTO SUBMISSION REQUIREMENTS AND CONTENT RESTRICTIONS

To constitute an entry into the Promotion, Photos must comply with the following requirements:

• Photos must be an original work created exclusively by the entrant and cannot be a duplicate that was previously submitted in the Promotion.
• Photos must be in digital format.
• Photos must be submitted as stated above for the applicable Facebook or Instagram Method of Entry.

Further, Photos must also comply with the following content restrictions:

• Other than the Sponsor, its brands and/or logos, the Photo may not show, contain, mention, depict, refer or otherwise allude to the name or logo of any retailer, manufacturer, brand, product, store, place of business, person, company or character in such a way or manner as to imply an affiliation with, or endorsement of, the Sponsor, its brands and/or this Promotion.
• Photos cannot contain any images, sculptures, paintings, logos and other works of art or images not created by entrant unless entrant also submits the necessary written permissions by the owner of such works of art or images.
• Photos must be entrant's own original work, created solely by entrant and not created professionally; must not have been previously published, released or distributed in any form; must not have won any award; and must not violate or infringe another's rights, including but not limited to copyright, trademark, privacy, publicity, intellectual property, or other personal or proprietary rights.
• Photos must not contain any content that is obscene, indecent, hateful, offensive or inappropriate, including, without limitation, nudity, pornography or profanity.
• Photos must not contain any content that promotes alcohol, illegal drugs or tobacco, firearms/weapons (or the use of any of the foregoing), the commission of a crime, or any political agenda or message.
• Photos cannot in any manner defame, misrepresent, contain disparaging remarks or reflect negatively about Sponsor, its services, or other people, products or companies or their products, or in any way reflect negatively upon such parties or explicitly or implicitly communicate messages or images inconsistent with the positive images and/or goodwill with which Sponsor wishes to be associated, as determined by Sponsor in its sole discretion.
• Photos cannot contain any personal identification, such as personal names, email addresses or street addresses.
• Photos must not contain any content that threatens any person, place, business, group or nation.
• Photos must not depict any harmful or dangerous act, nor may they depict or be the result of any activity that disturbs the peace or creates unsafe or hazardous conditions.
• Photos must not contain any content that in any other way violates applicable laws, standards or regulations.

The Sponsor reserves the right to review Photos for compliance with the aforementioned requirements and content restrictions and to determine which Photos are eligible to be awarded an entry in the Promotion. Such review does not relieve entrants from their responsibility to fully comply with these Official Rules. Photos that do not comply with these Official Rules or that otherwise contain prohibited or inappropriate content as determined by the Sponsor, at its sole and absolute discretion, may be disqualified and deemed ineligible to be awarded an entry in the Promotion. The Sponsor reserves the right, at its sole and absolute discretion, to refuse, remove or disqualify any Photos for any reason at any time. If a Photo is refused, removed or otherwise disqualified, the Sponsor shall not be obligated to notify entrant or to provide an explanation for the refusal, removal or disqualification. All decisions of the Sponsor are final.

6. PRIZES

The Prizes and their approximate retail values ("ARV") are as follows:

(a) Grand Prize. Subject to verification of eligibility and compliance with these Official Rules, one (1) entrant will be able to choose between an Above Ground Pool (Leslie's Epic Series) or a Leslie's MyLife S30L Hot Tub to be delivered by pallet to winner's driveway (the "Grand Prize Winner"). The Grand Prize Winner will also receive one (1) gorgeous Crosley Furniture patio set which includes one (1) sofa, two (2) armchairs, one (1) side table, and one (1) fire table and one (1) Water-Balancing Care Package to help maintain healthy, clean, and clear water. Items in the Water-Balancing Care Package will vary, depending on the Winner's region and chosen item.

The ARV, including taxes and shipping, of the Grand Prize is approximately Eight Thousand United States dollars ($8,000.00 USD), depending on the size of pool needed for the Grand Prize Winner's backyard or if a hot tub was chosen.

(b) Second Place Prize. Subject to verification of eligibility and compliance with these Official Rules, one (1) entrant will be able to choose between an Above Ground Pool (Leslie's Epic Series) or a Leslie's MyLife S30L Hot Tub to be delivered by pallet to winner's driveway (the "Second Prize Winner"). The Second Prize Winner will also receive one (1) Water-Balancing Care Package to help maintain healthy, clean, and clear water. Items in the Water-Balancing Care Package will vary, depending on the Winner's region and chosen item.

The ARV, including taxes and shipping, of the Second Place Prize is approximately Five Thousand United States dollars ($5,000.00 USD) depending on the size of pool needed for the Second Prize Winner's backyard or if a hot tub was chosen.

(c) Third Place Prize. Subject to verification of eligibility and compliance with these Official Rules, one (1) entrant will receive one (1) Crosley Furniture patio set, which includes one (1) sofa, two (2) armchairs, one (1) side table, and one (1) fire table (the “Third Prize Winner”).

The ARV, including taxes and shipping, of the Third Place Prize is approximately Three Thousand United States dollars ($3,000.00 USD).

The total ARV of the Grand Prize, Second Place Prize and Third Place Prize (each, a "Prize" and collectively, the "Prizes") is Sixteen Thousand United States dollars ($16,000.00 USD). The ARV for a Prize is an estimate made before the Promotion begins and may vary depending on the size of the pool needed for the winner's backyard or if a hot tub was chosen. If the actual retail value of the Prize is less than or greater than the stated ARV, the Prize winner will not receive the difference.

ALL FEDERAL, STATE, AND LOCAL TAXES AND FEES ARE THE SOLE RESPONSIBILITY OF THE PRIZE WINNERS. ALL OTHER COSTS AND EXPENSES RELATED TO ANY PRIZE NOT SPECIFIED HEREIN AND OTHER EXPENSES INCURRED BY ACCEPTING THE PRIZE ARE ALSO THE SOLE RESPONSIBILITY OF THE WINNER. ANY REQUIRED TAX REPORTING FORMS WILL BE FURNISHED TO THE APPROPRIATE AUTHORITIES.

7. PRIZE RESTRICTIONS

Limit one (1) Prize per person or household. Although multiple entries may be made, Prizes are limited to one (1) per household. That is, if there are two (2) Potential Winners living in the same household, only one (1) person may be eligible for a Prize (the household member who submitted the first entry into this Promotion will be deemed the eligible entrant). "Household members" shall mean those persons who share the same residence at least three (3) months a year. No more than the stated number of Prizes will be awarded. A Prize will be awarded only if the Potential Winner fully complies with these Official Rules. Sponsor shall have no responsibility or obligation to the Prize winner or a Potential Winner who is unable or unavailable to, or who does not for any reason, accept or utilize the Prize. All Prizes (or a component of the Prize) are subject to the terms and conditions of the issuer. All Prize details are at the sole and absolute discretion of Sponsor and any depiction of the Prize, in Promotion materials or otherwise, is for illustrative purposes only. Prize and Prize components are subject to availability and other restrictions all of which are subject to change at Sponsor's sole and absolute discretion. No transfer, refund, cash redemption, substitution, replacement or cash equivalent for a Prize or any Prize component will be made, except that Sponsor, at its sole and absolute discretion, may substitute a Prize (or component of a Prize) of equal or greater value for any reason.

Prizes must be claimed in and shipped to an address in the 50 United States and/or the District of Columbia (excluding Alaska, Florida, Hawaii, New York and Rhode Island), except in Sponsor's sole and absolute discretion. The above ground pool or hot tub Prize component, as applicable, will be delivered by freight to the Prize winner's driveway. Each Prize winner is responsible for assembling the above ground pool or hot tub, as applicable. Sponsor has no responsibility to assemble any Prize or Prize component. The Crosley Furniture Biscayne patio set Prize component as well as the Water-Balancing Care Package Prize component will be delivered via Federal Express. Sponsor is not responsible for and will not replace, except at its sole discretion, any Prize or Prize Component that is lost, stolen, or damaged during shipping.

LESLIE'S MAKES NO REPRESENTATION OR WARRANTY CONCERNING THE APPEARANCE, SAFETY OR PERFORMANCE OF THE PRIZES. ALL PRIZES ARE AWARDED AS IS AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE FROM SPONSOR. THE WINNER AGREES TO LOOK SOLELY TO ANY MANUFACTURER'S WARRANTY OR DEALER FOR ANY WARRANTY CLAIMS, DEFECTS, SERVICE OR OTHER PROBLEMS WITH THE PRIZE. SOME JURISDICTIONS MAY NOT ALLOW (OR MAY LIMIT) DISCLAIMERS OF CERTAIN WARRANTIES, IN WHICH CASE THE FOREGOING DISCLAIMERS WILL BE ENFORCED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8. PRIZE DRAWING; ODDS OF WINNING

Approximately twenty-one (21) business days after the end of the Promotion Period, there will be one (1) random drawing from all eligible entries received during the Promotion Period to select the three (3) potential winners of the Prizes (each, a "Potential Winner"). The Potential Winner of the Grand Prize will be randomly chosen first followed by the Potential Winner of the Second Place Prize and, finally, the Potential Winner of the Third Place Prize. Such drawing(s) shall be final and binding with respect to all matters related to the Promotion. The Potential Winners need not be present to win in the drawing but must be physically present when the Prize is delivered.

Odds of winning the Prize depend on the number of eligible entries received in the Promotion Period.

9. WINNER NOTIFICATION AND VERIFICATION

Within forty-eight (48) hours of the random drawing (10/28/20), the Potential Winners will be contacted with a verification email using the email address provided at the time of entry or via direct message on Instagram or Facebook depending on the method of entry. The Potential Winners will be awarded the applicable Prize subject to verification of eligibility and compliance with all terms and conditions of these Official Rules. If a Potential Winner fails to respond to the verification email or verification direct message on Instagram or Facebook depending on the method of entry within five (5) business days of notification or the email notification is returned as undeliverable after two (2) attempts, the Potential Winner may be disqualified in Sponsor's sole and absolute discretion.

A Potential Winner shall be required to sign and provide a copy of his/her valid driver's license or other form of identification for age verification, fully completed Winner Affidavit of Eligibility, Release of Liability, and Agreement to Rules and Prize Terms, and furnish a W-9 (collectively, the "Verification Documents") within five (5) business days from the date when Sponsor's initial verification email was sent. If a Potential Winner is not of the legal age of majority in his/her jurisdiction of residence, the Verification Documents may be required to be confirmed and signed by his/her parent or legal guardian, and the Prize may be awarded in the name of his/her parent or legal guardian who will be required to fulfill all requirements imposed on a Potential Winner as set forth herein. If a Potential Winner fails to complete, sign and return the applicable Verification Documents within the required time period, or if the forms are returned as undeliverable or incomplete, the Prize is forfeited, unless the time period is extended in writing by Leslie's, in their sole discretion.

In the event a Potential Winner is disqualified for any reason, or if a Prize is unclaimed, the Prize will be forfeit. At Leslie's sole and absolute discretion, Leslie's may award the forfeit Prize to an alternate Potential Winner by random drawing from among all remaining eligible entries. Within forty-eight (48) hours of the secondary drawing, alternate Potential Winner(s) will be contacted using the email address provided at the time of entry or via direct message on Instagram or Facebook depending on the method of entry. If the alternate Potential Winner(s) fails to respond to the verification email or verification direct message within five (5) business days of notification or the email notification is returned as undeliverable after two (2) attempts, the alternate Potential Winner may be disqualified in Sponsor's sole and absolute discretion. Sponsor retains the right to repeat this process until an alternate Potential Winner complies with the verification of eligibility requirements.

Each Prize winner must submit to Sponsor a photograph, for use in future marketing campaigns, that depicts the Prize winner with his/her Prize and such photograph must be in compliance with the Content Restrictions set forth in this Section 5, within thirty (30) days' of the Prize receipt. Should a Prize winner fail to do so, the winner will be required to promptly return to Leslie's, upon demand, the Prize.

ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR. SPONSOR'S DECISIONS AS TO THE ADMINISTRATION AND OPERATION OF THE PROMOTION, ANY CHANGES TO THESE OFFICIAL RULES, AND THE SELECTION OF POTENTIAL WINNERS IS FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION.

10. ADDITIONAL TERMS

Leslie's reserves the right, in its sole discretion, to modify, terminate, or suspend the Promotion should viruses, bugs, hacking, tampering, fraud, technical failures, unauthorized human intervention or other causes beyond Leslie's control which corrupt, manipulate or impair the administration, security or fairness of the Promotion. Leslie's is not responsible for any human error that may occur in the processing of the entries, nor is it responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, whether caused by the sender or any of the equipment or programming associated with or utilized in the Promotion. Leslie's reserves the right, in its sole discretion, to disqualify any individual found to have tampered with the entry process or the operation of the Promotion; to have acted in violation of these Official Rules; or to have acted in an unfair, deceptive or disruptive manner or with the intent to manipulate or affect the fairness of the Promotion, annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, mechanical, programmed or similar entry methods will void all such entries submitted by such methods. Leslie's and its agents are not responsible for any printing or technical error which may occur in processing, printing or distribution of Promotion materials. Leslie's reserves the right to make changes to these Official Rules in its discretion to ensure the fairness and proper running of the Promotion or for purposes of clarification.

11. MISCELLANEOUS

By participating in the Promotion, entrants agree to be bound by these Official Rules. No transfer, assignment, cash redemption or substitution of the Prize is permitted except that Leslie's, in its sole discretion, reserves the right to substitute a prize of equal or greater value. By participating in the Promotion, entrants release, indemnify and hold harmless Leslie's, and its respective parents, subsidiaries, affiliates, directors, officers, managers, owners, employees and agents (collectively, the "Released Parties"), from and against any claim or cause of action arising out of participation in the Promotion or the receipt, redemption or use of the Prize, even if caused or contributed to by the negligence of Leslie's, and its respective parents, subsidiaries, affiliates, directors, officers, managers, owners, employees and agents. Entrants agree that the decisions of Leslie's related to the Promotion and regarding the interpretation of these Official Rules and all drawings shall be final in all respects. By entering the Promotion, entrant agrees to waive any right to claim ambiguity or error in these Official Rules or in the Promotion itself.

12. LIMITATION OF LIABILITY

The Released Parties do not have any responsibility or liability whatsoever for: (a) unauthorized human intervention in any part of the entry process or the Promotion; (b) electronic or human error which may occur in the administration of the Promotion or the processing of entries; (c) any property loss, damage, personal injury, or death, in connection with the Prize provided pursuant to the Promotion and/or any person's participating in the Promotion; (d) any printing or typographical errors in any Promotion-related materials; (e) stolen, lost, late, postage-due, misdirected, corrupted, incomplete, damaged, failure of mail delivery or indecipherable entries; or (f) technical failures of any kind, including but not limited to the malfunctioning of any computer, mobile device, cable, network, hardware or software (if applicable), as well as any failure of the website during the Promotion Period.

13. ARBITRATION ONLY/NO CLASS ARBITRATION/WAIVER OF JURY TRIAL/CHOICE OF LAW

(a) As a condition of participating in this Promotion, entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or connected with this Promotion, or the Prize obtained through the Promotion, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration under the Commercial Arbitration Rules of the American Arbitration Association as then in existence, including the question of arbitrability of any issue. This means an entrant will not have the right to litigate a claim in court or have a jury trial. Further, an entrant will not have the right to participate in a representative capacity or as a member of any class of claimants pertaining to any dispute, claim or cause of action arbitrated hereunder. Arbitration will take place in Phoenix, Arizona, at a location selected by Leslie's and the Arbitrator's decision shall be final; (2) any and all resulting claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Promotion, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to seek recovery for, and entrant hereby waives all rights to claim punitive, exemplary, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and waives any and all rights to have damages multiplied or otherwise increased.

(b) All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of an entrant and Leslie's in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Arizona, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Arizona, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Arizona. Notwithstanding the requirement of arbitration, each entrant further agrees that the exclusive venue of any legal proceeding involving or in any way arising out of the Promotion, or arbitration, shall be in the federal or state courts of Maricopa County, Arizona and entrant consents to the personal jurisdiction of same.

14. EXTENDED MEANINGS; FORCE MAJEURE

Unless otherwise specified in these Official Rules, words importing the singular include the plural and vice versa and words importing gender include all genders. All dollar amounts referred to in these Official Rules are in lawful money of the United States of America. The Released Parties are not responsible for any damages caused by delay or failure to perform undertakings pursuant to these Official Rules when the delay or failure is due to weather, pandemics, event cancellations, fires, strikes, floods, acts of God or the state's enemies, lawful acts of public authorities, delays or defaults caused by common carriers, or other events that cannot reasonably be foreseen or provided against.

15. OFFICIAL RULES; NAME OF WINNER

For a Winners' List or a copy of these Official Rules, send a self-addressed, stamped envelope to: Leslie's Poolmart, Inc., "Summer Salute Sweepstakes", 2005 E Indian School Road, Phoenix, AZ 85016, Attn: Marketing Department, and indicate Winners' List or Official Rules. The Winners' List will be available after October 28, 2020, and requests must be received no later than four (4) months after that date.

16. PUBLICITY RELEASE AND USE OF PERSONAL INFORMATION

Except where prohibited by law, by participating in this Promotion and/or accepting a Prize, you grant Sponsor and its designees the right to use your name, photograph, likeness, statements, biographical information, testimonials, personal story, voice, address, and other identifying information for any and all commercial purposes of the Sponsor, including, without limitation, advertising and promotional purposes for this and similar promotions, worldwide, and in perpetuity, in any and all forms of media, now known or hereafter devised without additional compensation, review or approval rights, notification or permission. Sponsor shall contact each Prize winner via email to obtain a photograph of each Prize winner with his/her Prize, within thirty (30) days' of the Prize receipt, that depicts the Prize winner with his/her Prize and in compliance with the Content Restrictions set forth in Section 5.

As set forth in Section 9, a Prize winner shall also provide written consent except where prohibited, required by Leslie's to formalize, effect or perfect such consent to Leslie's use of his/her name, photograph, likeness, statements, biographical information, testimonials, personal story, voice, address, and other identifying information advertising/publicity/trade without compensation, notice or approval; and Prize winners disclaim any ownership rights of such advertising/publicity/trade material. Should a Prize winner make any false statement in connection with this Promotion, the Prize winner will be required to promptly return to Leslie's, upon demand, the Prize.

All personal information collected through the Promotion is subject to Leslie's Privacy Policy, located at https://lesliespool.com/privacy-policy.html. By participating in the Promotion, entrant agrees to Leslie's use of entrant's information for Leslie's marketing purposes, subject to entrant's election to unsubscribe to any marketing communications received from a Sponsor. Leslie's will not sell an entrant's information to third parties. Entrant should review the privacy policy of Instagram or Facebook depending on the method of entry into the Promotion.

YOU FURTHER ACKNOWLEDGE THAT YOUR PERSONAL IDENTIFYING INFORMATION MAY BE DISCLOSED TO THIRD PARTIES INCLUDING, WITHOUT LIMITATION, PLACING YOUR NAME ON A WINNERS' LIST.

17. OPTING OUT

When an entrant receives sales flyers, advertisements, direct mail, and other promotion communications from Leslie's, including email, an entrant may "opt out" by following the "unsubscribe" instructions in the email received or by contacting Leslie's directly at 1 800 537 5437. Leslie's will use commercially reasonable efforts to update their files to reflect the request as promptly as possible.
